Purpose: This EULA is intended for the installer, first-run screen, account creation and in-app legal acceptance flow.

This End User Licence Agreement is the all-in-one app EULA for EDR Broadcast. It is intended for the installer, first-run screen, account creation and in-app legal acceptance flow.

1. Who This Agreement Is With

This End User Licence Agreement is between you and M.C HALDEN & C.D WILSON, a partnership trading as EDR APPS / EDR Broadcast under ABN 52 315 882 514.

2. What This EULA Covers

This EULA applies to your download, installation and use of the EDR Broadcast desktop app and related app services, including accounts, licensing, subscriptions, overlays, remote browser control, public live timing, update checks, support and diagnostic features.

By downloading, installing, creating an account, starting a trial, subscribing to, or using EDR Broadcast, you agree to this EULA.

If you use EDR Broadcast for a league, team, broadcaster, business or other organisation, you confirm that you have authority to accept this EULA for that organisation.

3. App Licence

Subject to this EULA and your plan, EDR APPS grants you a limited, non-exclusive, non-transferable and revocable licence to install and use EDR Broadcast for your own authorised broadcasts, league broadcasts, team broadcasts or production work.

You do not own the app. EDR APPS and its licensors retain ownership of EDR Broadcast, including the app, code, overlays, themes, designs, text, graphics, documentation and related intellectual property.

4. Licence Restrictions

You must not:

• copy, sell, rent, sublicense, resell, host or redistribute EDR Broadcast;
• bypass licensing, subscription, watermark, PC, operator, plan or entitlement limits;
• reverse engineer, decompile, modify or tamper with the app except where the law allows;
• use another person’s licence, account, subscription or machine activation without permission;
• attack, probe, overload, scrape or interfere with EDR APPS systems;
• use EDR Broadcast to harass, defame, dox, target or unlawfully monitor any person;
• use EDR Broadcast in a way that infringes copyright, trade marks, privacy rights or other rights.

5. Accounts And Security

You must provide accurate account information and keep your login details secure.

You are responsible for activity under your account, including operators or crew members you invite to use EDR Broadcast.

You must notify us promptly if you believe your account, licence, remote-control room or subscription access has been compromised.

6. Trial

EDR Broadcast may offer a 14-day Pro free trial.

The trial does not require a credit card or payment method and does not automatically convert into a paid subscription.

When the trial ends, Pro features stop unless you choose a paid plan.

Only one trial may be available per person, account, organisation or device unless we agree otherwise.

7. Paid Plans, Billing And Cancellation

Paid plans renew monthly unless cancelled before the next billing date.

Prices are shown in AUD unless stated otherwise.

You can manage or cancel your subscription through the Stripe billing portal: Stripe billing portal.

You can also contact apps@endurotechracing.com for help.

Cancellation stops future renewals.

Paid features continue until the end of the current billing period unless we say otherwise or the law requires a different outcome.

Licensing/access is removed or downgraded when the paid period expires.

Deleting your EDR Broadcast account does not automatically cancel billing. If you have an active paid subscription, you must also cancel it through Stripe.

8. Refunds

EDR Broadcast subscriptions may be eligible for a refund if requested within 7 days of first purchase by contacting apps@endurotechracing.com.

This 7-day refund period applies to EDR Broadcast subscriptions only and does not apply to EDR Store items, including merchandise such as T-shirts.

Renewal refunds are discretionary unless required by law.

Your rights under applicable consumer laws are not limited by this EULA.

9. Device Licensing And PC Limits

EDR Broadcast uses a hashed device identifier to manage licensing, PC limits and activations.

Raw hardware details are not stored by EDR servers.

Plan limits may restrict the number of PCs, operators, remote sessions or features you can use.

You must not bypass those limits.

10. Remote Browser Control

Remote browser control lets authorised operators control parts of a broadcast from a browser.

Remote rooms use access controls such as invite or secret-link access, optional invite-only approval, role permissions, host revoke/kick controls, entitlement checks, rate limiting and session expiry/closure controls.

You are responsible for:

• sharing control access only with authorised operators;
• revoking access when operators no longer need it;
• supervising operator actions;
• ensuring the remote control room is used only for broadcasts you are authorised to operate;
• keeping broadcast and league access secure.

We may suspend or restrict remote-control access if we reasonably believe it is being misused, compromised or used in breach of this EULA.

11. Public Live Timing And Race/Session Data

If you enable public live timing or share a live-timing link, the live-timing page is hosted by EDR APPS and race/session information is sent to EDR servers so the page can operate.

Public live-timing information may be visible to anyone with access to the link until the remote session is closed or expires.

Public live-timing information may include driver names or handles, team names, car numbers, class, position, lap times, sector times, timing gaps, incident markers, iRating if enabled, and related session details.

EDR APPS wipes race/session data and public live-timing data after the remote session is closed or expires.

Some non-timing room/session metadata may be retained for up to 90 days after closure or expiry for operations, abuse prevention and support.

You are responsible for deciding whether live timing should be public, whether driver/session information may be shared, and whether publication complies with league rules, privacy obligations and platform rules.

12. Incident Logs And Operator Actions

Incident logs are stored locally only, except that current incident/timing information may be displayed to connected remote viewers/controllers while a live remote or public timing session is active.

EDR APPS does not retain server-side incident logs after the session closes or expires.

Operator control actions, such as camera changes or replay triggers, are not persisted server-side based on the current product design.

13. Support, Logs And Diagnostics

If you contact us for support, we may ask for details such as your account email, app version, device information, screenshots, logs or diagnostic files.

EDR Broadcast does not currently use third-party crash reporting and does not automatically upload crash/error reports from the desktop app.

Error logs and diagnostic bundles are stored locally on your device unless you choose to send them to us for support.

14. Updates, Code Signing And Uninstalling

Auto-update functionality is planned for a future release.

Code signing is not currently available and is planned for a future release.

Until auto updates are available, users may need to install updates manually from the official EDR Broadcast download page.

You can uninstall EDR Broadcast through Windows Add/Remove Programs.

Only download EDR Broadcast from official EDR APPS / EDR Broadcast links. Do not install modified or unofficial copies.

15. Broadcast Content And User Responsibility

You are responsible for your broadcast, stream, overlays, commentary, sponsor content, logos, liveries, graphics, music, videos, ads, custom themes and any other content you use with EDR Broadcast.

You must have all rights, permissions and licences needed for your broadcast content.

You are also responsible for complying with Twitch, YouTube, Facebook, Discord, iRacing, league rules, event rules and all applicable laws.

16. Third-Party Services

EDR Broadcast may interact with or depend on third-party services including iRacing, OBS, Stripe, Supabase, SiteHost, Google Analytics, Google Search Console, Brevo, Twitch, Discord, operating systems, browsers, social platforms and streaming platforms.

Third-party services have their own terms and privacy policies.

We are not responsible for third-party changes, outages, restrictions or compatibility issues, except where the law says otherwise.

17. iRacing Non-Affiliation

EDR Broadcast is an independent tool and is not endorsed by, sponsored by, approved by or affiliated with iRacing.com Motorsport Simulations, LLC.

iRacing and related names, logos and data remain the property of their respective owners.

18. Privacy

Our Privacy Policy explains how we collect, use, store, share and delete information.

You can request access, correction, export or deletion of personal information by emailing apps@endurotechracing.com from the email address linked to your EDR Broadcast account.

We aim to complete verified deletion requests within 7 days.

Account and service data will be deleted from active systems, except for records we are legally required or reasonably entitled to retain, such as billing, tax, accounting, fraud prevention, security, legal compliance or dispute records.

Account deletion does not automatically cancel billing.

19. Acceptable Use

You must not use EDR Broadcast to:

• harass, defame, threaten, dox or target any person;
• publish private race/control links without permission;
• infringe copyright, trade marks, privacy rights or publicity rights;
• misrepresent affiliation with EDR APPS, Endurotech Racing, iRacing, a league or a sponsor;
• bypass licences, payment, device limits, watermarks or operator limits;
• interfere with another person’s broadcast;
• probe, scrape, overload, reverse engineer or attack our systems;
• use EDR Broadcast for unlawful purposes.

20. Suspension And Termination

We may suspend or terminate access if:

• you do not pay fees when due;
• you breach this EULA;
• you misuse remote control or public live timing;
• your account creates a security risk;
• you infringe intellectual property rights;
• we are required to do so by law;
• continued access would create risk for us, users, leagues, drivers or third parties.

When your licence ends, you must stop using paid features and any parts of EDR Broadcast that require an active licence.

21. Disclaimers

To the maximum extent allowed by law, EDR Broadcast is provided on an “as is” and “as available” basis.

Broadcast automation, incident detection, timing, telemetry, overlays, camera logic and replay cues are assistive tools. They may be delayed, incomplete, inaccurate or unavailable.

You should rehearse, test and monitor your broadcast before relying on EDR Broadcast for a live event.

We do not guarantee uninterrupted or error-free operation.

22. Limitation Of Liability

To the maximum extent allowed by law, we are not liable for indirect, special, incidental, consequential or loss-of-profit damages, including lost broadcast revenue, sponsorship loss, platform penalties, league penalties, loss of goodwill, lost data or loss caused by third-party services.

This clause does not exclude liability that cannot be excluded by law.

23. Consumer Rights

Nothing in this EULA excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded, restricted or modified by law.

24. Changes To This EULA

We may update this EULA from time to time.

If changes are material, we may notify you through the app, website, email or another reasonable method.

Continuing to use EDR Broadcast after changes take effect means you accept the updated EULA.

25. Governing Law

This EULA is governed by the laws of Queensland, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from those courts.
